Section 602 of the Texas Probate Code requires if such are available and appropriate, use of least restrictive alternatives to guardianships. Courts are mandated to encourage the development or maintenance of self-reliance and independence of proposed wards. Therefore, in the vast number of guardianship cases, a lesser restrictive alternative should be sought after first before a court will grant a guardianship.
The following is an incomplete list of alternatives to guardianships:
- Joint bank accounts;
- Appointment of a representative payee for receipt of social security benefits;
- Managing and possessory conservatorships for minors;
- Durable Power of Attorney (financial and/or medical);
- Grantor Trusts with incapacity planning provisions; and
- Special needs Trusts.
