Guardianship proceedings are the subject of intense court supervision and control. Properly maintaining the court’s supervision over the guardianship requires the guardian to prepare and submit a large number of applications to keep the court informed about the guardianship and seek court approval of all actions.

The guardian of the person must provide food, clothing, medical care, and shelter for the ward. The guardian of the estate must take care of and manage the estate of the ward. A guardian will incur expenses while accomplishing these objectives. A guardian is not required to spend personal funds to provide for the ward, but he or she may not expend funds of the ward’s estate unless specifically authorized by the Probate Code or by prior court approval.

These required time sensitive administrative procedures are vital to the continued court approval of the guardianship. Navigating the administrative requirements for guardianships can be difficult if a guardian is not adequate versed in this area of the law or has not aligned himself or herself with a guardianship lawyer. Personal liability and/or criminal prosecution are possible ramification to guardians who fail to adhere to the formalities and expectations of guardianship administrations. For these reasons, Marold Law Firm, PLLC strongly encourages the affiliation with a guardianship attorney while administering any guardianship.
